The petitioner is alleged to have inflicted injuries on the person of Bawa Ram with reverse side of a datar. It has inter alia been argued by the counsel for the petitioner that the injuries found on the head portion of deceased Bawa Ram in the occurrence dated 21.2.2007 were already existing on 19.2.2007. In support of his contention, he has referred to the report of CT Scan Centre dated 19.2.2007 reflecting existence of a fracture on frontal bone on the left side. The specific injury is attributed to the petitioner and the petitioner is seeking bail on the basis of contradiction in the medical evidence and ocular evidence, on the basis of a medical report available with the petitioner. No opinion can be formed regarding the involvement or non involvement of the petitioner as it will not be appropriate to appreciate the evidence. The medical evidence is always in the nature of corroborative evidence. The ocular version of PWs cannot be doubted on the basis of medical evidence, which is sought to be produced in defence by the petitioner.
