Petitioner has brought this petition under Section 439 of the Code of Criminal Procedure for seeking regular bail in case F.I.R.No.RC 2 (S)/2007 dated 23.02.2007 under Section 120-B read with Section 302, 201, 167, 218 I.P.C., registered at Police Station CBI/SEB, Chandigarh.
Admittedly, the petitioner is not alleged to have caused any injury to the deceased. He was also not named in the F.I.R. The petitioner is in custody since 2008. The main accused is already in custody. This Court, vide order dated 19.11.2008, passed in Criminal Misc.No.M-25684 of 2008, has already granted bail to co-accused Anup Kumar, against whom the allegations were the same as that of the petitioner.
In the given facts and circumstances and without commenting on the merits of this case, the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the Trial Court. Criminal Misc. is disposed of.
