Baldev Singh Vs State of Punjab

The petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Kashmir Singh alleging that on 17.7.2008 the petitioner had caused injuries on his person. The petitioner has been attributed a datar blow on the elbow of left arm. A perusal of the police file indicates that during investigation the injury attributed to the petitioner on the left arm of the complainant was found to be self suffered. The petitioner has already joined the investigation.

Learned counsel for the complainant has opposed the petition. Taking into consideration the dual version regarding the nature of the injury attributed to the petitioner, he can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be admitted to bail to the satisfaction of the arresting officer subject to the condition that he will appear before the investigating officer as and when required by the police and will not tamper with evidence or hamper the investigation at any stage. The petitioner will be required to furnish fresh bail bonds in case the challan is presented against him.
