Petitioner claims that she has been gang raped. FIR has been registered against Abbar Rehman, Abdul and Mussa.

In the reply filed by S.H.O Police Station Ferozepur Jhirka, on behalf of respondents No. 1 to 4 it has been mentioned that petitioner have given an application on 22.12.2008 in police Station Ferozepur Jhirka alleging that while she was alone in her house, she was raped by above said three persons along with two or three others whose name she did not know. The petitioner was medico legally examined at General Hospital Gurgaon. Thereafter, during the course of verification of the facts of this case, the respectable persons of the village including husband and father-in-law of the prosecutrix gave an application in the Police Station Ferozepur Jhirka on 26.01.2009 stating therein that they have given an application in the Police Station regarding rape of petitioner and that they had compromised the matter orally and they are satisfied that rape was not committed upon the petitioner and that they do not want any action. The said application was filed. It is also mentioned in the reply that a copy of the application Annexure R-1 is annexed with reply. But Annexure R-1 has not been

Without entering into the disputed question of fact, this petition is disposed of with a direction to the S.P. Mewat to get the matter inquired into regarding the authenticity of allegations of the petitioner in accordance with law within three months, henceforth. In case the allegations are found to be correct, necessary action be taken against the culprits, irrespective of any alleged compromise between the parties.
