The petitioner seeks the concession of bail in a case registered at the instance of Naresh Kumar alleging that the petitioner along with others had scaled the wall of the factory premises, over powered the complainant, assaulted him and broke open the locks to take away two bags of brass scrap. The co-accused of the petitioner Om Pal Singh has already been granted the concession of bail. The petitioner has been in custody for the last more than 8 months. Naresh Kumar has already been examined. Chances of tampering with the evidence are remote.
The petition is allowed and the petitioner is ordered to be released on bail on furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
