Counsel for the petitioner contends that the petitioner is in custody since August, 2008. He submits that the prosecutrix, namely, Neetu Rani, has been examined before the trial Court and she has given her statement in her cross-examination, wherein she has admitted that she had been accompanying the petitioner to various places. She has also admitted that she had been residing with him in a room, which was hired by him and had been going out of the room to the bathroom where other people were also residing but she had never either raised any alarm nor complained to any of the people around there.
In view of the statement of the prosecutrix, which has been placed on record as Annexure P-6 and keeping in view the fact that the petitioner is in custody since August, 2008, the petitioner is directed to be

released on bail to the satisfaction of the trial Court.
Any observation made hereinabove shall have no bearing on
the merits before the trial Court.
