Harpreet Singh Vs State of Punjab and Anr.

Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to him in a criminal complaint titled as Shiv Kumar vs. Harpreet Singh, pending before the Court of Judicial Magistrate Ist Class, Amritsar, under Section 138 of the Negotiable Instruments Act ,1881.

At the time of issuance of notice of motion dated 23.4.2009 the following order passed:-

“ Notice of motion for 19.5..2009.

In the meantime, the petitioner is directed to

surrender before the trial Court on or before 25.4.2009 and the trial Court shall release the petitioner on interim bail subject to its satisfaction".

Learned counsel for the petitioner has submitted that in pursuant to the above order, the petitioner had surrendered before the trial Court and has been released on interim bail.

Accordingly,this petition is allowed and the order granting

interim bail dated 23.4.2009 is made absolute.
