Counsel for the petitioner, inter alia, contends that at the time of presentation of challan, the petitioner was kept in Column No.II but later on, on the statement of complainant, he has been summoned under Section 319 Cr.P.C. Counsel for the petitioner further submits that there is deliberate improvement in the statement of PW1 Balwinder Singh, author of the FIR. He further submits that in terms of the order dated 27.4.2009 passed by this Court, the petitioner has appeared before the Court below and has been enlarged on bail on 15.5.2009. Counsel for the State on instructions received from HC Tarvinder Kumar, submits that the petitioner has appeared before the trial Court and has been released on bail.
In view of above, order dated 27.4.2009 is hereby made absolute. The petition is disposed of.
