The petition is allowed in limine and the order dated October 3, 2009 issuing warrants of attachment against the property of the petitioner is set aside and a direction is given to the Executing Court to consider the objections afresh in the light of the documentary evidence produced by the petitioner. In case the Executing Court arrives at a conclusion that the money decree has not been satisfied, it will be open to the Executing Court to pass fresh orders of attachment of property. It is made clear that in case any such attachment order is passed, it will be open to the petitioner to file objections to the attachment as per provisions of Order 21 Rule 58 CPC. In case of dismissal of objections, the remedy of appeal under Order 21 Rule 58 (4) CPC would be available to the petitioner. It is ordered that the entire exercise of adjudication of the objections Annexure P-2, will be completed within a period of one month and the same would be disposed of by a speaking order after giving a fair opportunity to the petitioner.
