A specific prayer has been made by the learned counsel the petitioner to withdraw the instant petition and to file fresh application on the same cause of action in view of the judgment titled as H.S. Ahammed Hussain vs. Irfan Ahammed, 2002 (3) RCR (Civil) 563 wherein it was observed that it was not proper to order fixed deposit of the amount in case of adults.
Under the circumstances, the instant petition is dismissed as withdrawn with liberty to file fresh application on the same cause of action.
