This revision petition has been preferred by the tenant – petitioner challenging the judgment dated 12.9.1996 passed by Appellate Authority, Bhiwani, fixing the fair rent at Rs.275/- per month, for the shop situated in Bichla Bazar, Bhiwani, whereas, the Rent Controller had dismissed petition for rent filed by the landlord - respondent.
Having scrutinized the judgment, no such defect, much less any
illegality or irregularity has been detected, rendering the impugned judgment as illegal and resulting into miscarriage of justice. The fair rent was fixed way back in the year 1996 by the Appellate Court at the meager rate of Rs.275/- per month. Since then, there is steep rise in the price-index, therefore, the rate of rent, fixed by the Appellate Authority cannot be said to be on higher side in the present economic scenario.
Dismissed.
