Consequent upon the order passed by this Court on 10.12.2008, learned counsel for respondent Nos. 1 to 3 having sought instructions from Mr.Lachhman Dass, Assistant Consolidation Officer, Gurgaon, and has handed over to us a site plan. The same is taken on record and marked as Annexure-A. On the basis of Annexure-A, it is submitted on behalf of respondent Nos. 1 to 3, that the construction on the plot of the petitioner can be saved if the “phirni” is re-aligned, so as to run along the killa line of khasra No.7/20.
The proposal made by the learned counsel for respondent Nos. 1 to 3, is acceptable to the learned counsel for the petitioner.
In view of the above, the instant writ petition is allowed. The

“phirni” earlier carved out shall now run along the killa line of khasra No.7/20.
Writ petition stands disposed of in the aforesaid terms.
