Learned State counsel informs that though the petitioners did join the investigation but was not cooperative in the matter of recovery of amount.
As per the allegation, petitioners initially agreed to enter into an agreement to sell the land under reference to the complainant but instead of honouring that agreement opted to sell that land to a third party even before the date of execution of the registration of sale deed in favour of the complainant was over.
Prima-facie it makes out a case of civil character. There is no question of effecting of any recovery of any cash amount from the petitioners.
In the light thereof, the order dated 16.09.2008 is made
absolute.
Disposed of accordingly.
