The learned State counsel, under instructions from SI – Atma Singh, informs that the petitioners did not join investigation. A similar averment was made on behalf of the State on 06.11.2008 as well. In the fact thereof, the learned counsel for the petitioners had conceded the correctness of that averment and assured that the petitioners would join investigation on 07.11.2008. Again, the petitioners did not comply with the undertaking which had been given to this Court under instructions of the petitioners only. It is in the light of the persistent default on the part of the petitioners to join investigation that this Court had ordered the vacation of the

interim order dated 05.09.2008. Even thereafter, the petitioners did not join investigation.
In the circumstances of the case, the anticipatory bail
plea of the petitioners shall stand declined.
