Javed Akhtar Vs State of Punjab and Ors.

The petition has been filed under Section 482 Cr.P.C. seeking directions to respondent Nos.2 and 3 to investigate FIR No.141 dated 22.9.2007, under Sections 323, 324, 380, 427, 452, 148 and 149 IPC, Police Station, City, Malerkotla, and initiate action against respondent Nos.4 to 10.

Contention of the learned counsel is that although 10 months have gone by, no action has been taken. The accused have not been arrested. Rather the officials of Police Station, Malerkotla, have been threatening the petitioner with dire consequences if the FIR case is pursued. The petitioner is further being threatened that in case the petitioner does not

withdraw the case, proceedings under Section 182 Cr.P.C. would be initiated against him. In the above regards, an application, Annexure P-1, was made on which, however, no action has been taken.

Having regard to the facts of the case, it

would be appropriate to direct the Senior Superintendent of Police, Sangrur, (respondent No.2) to have an enquiry conducted into the allegations made in the petition, a copy whereof would be supplied alongwith a certified copy of the order passed today.

Needful be done within 30 days of the

receipt of certified copy of the order.

Respondent No.2 shall ensure that

investigation is carried out as per the provisions of the Code of Criminal Procedure.

Petition is disposed of accordingly.
