Present : Mr. J.S. Brar, Advocate for the petitioner. Mr. B.S. Baath, AAG, Punjab.
Prayer in this petition is, for grant of anticipatory bail in case FIR No.257 dated 25.7.2006, registered under Sections 307/427 of the Indian Penal Code at Police Station City Moga, Distt. Moga.
Vide order of this Court dated 28.9.2006, it was directed that in the event of arrest of the petitioner, he shall be released on bail, subject to the conditions enumerated therein.
Counsel for the petitioner submits that the petitioner has joined investigation, therefore, his custodial interrogation is not required.
Counsel for the State of Punjab, does not deny the aforementioned fact and states that custodial interrogation of the petitioner is not required.
In view of what has been stated above, the order of this Court dated 28.9.2006 is made absolute, subject to the provisions of Section 438 of the Cr.P.C.
This petition stands disposed of accordingly.
