Petitioner Rajbir Singh Gulia has filed this petition under Section 482 of the Code of Criminal Procedure for quashing of FIR No. 16 dated 4.4.2006 under Section 420 IPC, registered at Police Station State Vigilance Bureau, Hisar, on the ground that in view of the law laid down by the Supreme Court in T.T. Antony v. State of Kerala, 2001 (3) RCR (Criminal) 436, second FIR on the same allegations cannot be registered.
Counsel for the respondent-State states that after investigation, the police has prepared the cancellation report and the same has been submitted to the Court of Chief Judicial Magistrate, Jind.
In view of the aforesaid fact, counsel for the petitioner states that the petitioner does not want to press this petition at this stage with liberty to approach again in case, the cancellation report is not accepted.
Dismissed as not pressed with the aforesaid liberty.
