5 21-01-2026 Heard learned counsel for the parties.

The present contempt application has been filed for

¶40

non-compliance of the order dated 08.04.2022 passed in CWJC No. 4426 of 2022.

¶41

The Writ Court, while disposing of the writ application, had issued the following directions:-

“As such, petition stands disposed of in the following terms:-

¶43

(a) Liberty reserved to the petitioner to take recourse to such remedies as are otherwise available in accordance with law;

¶44

(b) We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable

dispatch;

(c) The authority concerned shall consider and dispose of the matter expeditiously by a reasoned and speaking order preferably within a period of four months from the date of approaching the petitioner before the appropriate authority;

(d) Needless to add, while considering and deciding the matter, principles of natural justice shall be followed and due opportunity of hearing afforded to the parties;

¶49

(e) Liberty reserved to the petitioner to approach the appropriate forum/Court, should the need so arise subsequently on the same and subsequent cause of action;

(f) We have not expressed any opinion on merits. All issues are left open;

¶51

(g) The proceedings, during the time of current Pandemic- Covid-19 shall be conducted through digital mode, unless the parties otherwise mutually agree to meet in person i.e. physical mode.

The petition stands disposed of in the aforesaid terms.”

In pursuance of the observations and directions issued by the Writ Court, a proceeding, being Encroachment Case No. 9 of 2025-26 was initiated and a final order was passed on 04.11.2025 (Annexure-A to the show cause).

In view of the fact that the directions issued by the Writ Court has already been duly complied with and a final order has been passed, this Court is of the view that no further order is required to be passed in the present contempt application.
