Petitioner has inter alia prayed for following reliefs

in the paragraphs No.1 of the writ petition:-

“i. For issuance of an appropriate writ in the nature of Mandamus, commanding the respondents concerned for payment of post retirement benefits, such as unutilized leave, remaining amount of gratuity and 10% monthly pension with statutory interest to the Petitioner w.e.f. 01.10.2023, as the petitioner has superannuated from service on 30.09.2023, from the post of Assistant Professor in the subject of History from Laxmishwaripriya Raj Laxmi Sanskrit College, Samaul, Birsayar, Madhubani.

ii. For issuance of appropriate direction to the concerned respondents for payment of difference of entire post retirement benefits and monthly pension, on the basis of 7th Pay Revision, w.e.f. 01.04.2017 and for payment of all consequential benefits, thereof.

ili. For issuance of appropriate direction to the concerned respondents for return of Rs.12,23,057l-, with statutory interest, as the aforesaid amount has been deducted from the petitioner's post retirement benefits, which has been mentioned in his PPO NO. A 180/23 dated 22.09.2023.

iv. For issuance of appropriate direction to the concerned respondents for revision of petitioner's monthly pension w.e.f. 01.10.2023, on the basis of 7 Pay Revision and all consequential benefits thereof.

v. For issuance of appropriate direction to the concerned respondents for payment of 25% salary to the petitioner, for the period of March, 2023 to September,2023, which has been deducted from the petitioner's salary, without any rhyme and reasons.

vi. For grant of other relief / reliefs, to which the petitioner may found entitled, on the facts and circumstances of the case.”

petitioner submitted that case of the petitioner is that post retiral benefit, with interest w.e.f . 01.10.2023 has not been paid to the petitioner. Petitioner is also aggrieved on account of recovery of Rs.12,23,057/- which according to the petitioner is

not in accordance with law. However, petitioner seeks to file a detailed representation for the relief as prayed for in the present writ petition before the authority concerned.

Considering the relief as prayed for in the present writ petition, the authority concerned is directed to redress the grievance of the petitioner well within a period of three weeks from the date of communication of this order.

It is made clear that the petitioner can also claim for interest on account of delayed payment from the date of his entitlement till the date of his dues will be paid under different heads. The calculation chart so furnished must also be accompanied with the reason for alleged recovery of Rs.12,23,057/- and in case the same is not in accordance with law, the petitioner is entitled for refund of recovered amount along with statutory interest within the said period.
