The grievance of the petitioner is in a limited bound,

whereby the petitioner is said to have been deprived from arrears of difference of salary consequent upon grant of ACP/MACP which comes to Rs.1,99,096/- as per the calculation.

Learned Advocate for the petitioner submitted that

the father of the petitioner died in harness on 18.05.2011 leaving behind his four sons including the petitioner. The mother of the petitioner also predeceased the erstwhile employee on 15.04.2011. When the petitioner has not been extended the rightful entitlement of his father, he moved before this Court in CWJC No. 2028 of 2018 for payment of due amount and all the death cum-terminal benefits, besides arrears of salary and difference thereof. The writ petition came to be disposed of vide order dated 11.10.2018. The petitioner filed CWJC No. 7585 of 2020 seeking extension of benefit under ACP/MACP scheme. The petitioner has also been compelled to file MJC No. 203 of 2022 for non compliance of the order of this Court. However, despite pursuing unwanted forced litigation by the petitioner, till date he has been deprived from arrears of salary even on account of extending benefit of ACP/MACP to the tune of Rs.1,99,096/-. For redressal of such grievance, the petitioner also filed a representation before the Registrar of the Magadh University, Bodh Gaya on 07.11.2025, copy of which is placed on record as Annexure-P/10 to the supplementary affidavit.

Mr. Sriram Krishna, learned Advocate for the Magadh University submitted at the Bar that the petitioner has already approached before the Registrar of the University, who

is the competent authority to look into the matter and pass appropriate order, in accordance with law.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the limited grievance of the petitioner, this Court deems it apt and proper to dispose of the writ petition with a direction to the Registrar of the Magadh University, Bodh Gaya to consider the representation of the petitioner as contained in Annexure-P/10 dated 07.11.2025 and bring to its logical conclusion by passing appropriate order, preferably within a period of eight weeks from the date of receipt/production of a copy of this order. Suffice it to observe that if the claim of the petitioner finds favour, necessary monetary benefit must be accorded to him within the period stipulated.
