Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Civil Lines P.S. Case No. 93 of 2025 registered for the offences punishable under Sections 316(2), 318(4), 303(2) and 3(5) of the BNS.

The allegation in the FIR is that the petitioner and one Prachi Chaurasiya were employed by a school for the collection of fees. On 17.02.2025, at about 2:00 p.m., the petitioner and the co-accused suddenly left the school. Upon enquiry, it was found that Rs.30,000/- was missing from the fee

collection amount. It is further alleged that the petitioner and the co-accused had misappropriated a total sum of Rs.4,00,000/- in last 6-7 months.

It is submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner and the coaccused had a dispute with the school management regarding the payment of their salaries. As the management failed to resolve the issue, they left the school premises on 18.02.2025. Thereafter, the management lodged the present FIR on 21.02.2025. Learned counsel further draws the attention of this Court to the petitioner's employment agreement with the school, which shows that it was executed on 04.10.2024. It is submitted that the allegations of misappropriation for the preceding six to seven months are, therefore, not sustainable. Learned counsel also draws the attention of this Court to the order dated 04.02.2026 passed by the Coordinate Bench in Cr. Misc. No. 7504 of 2026, whereby anticipatory bail was granted to the coaccused, Prachi Chaurasiya. It is further submitted that the petitioner is a teenage girl and has no criminal antecedents..

The learned counsel for State duly assisted by learned counsel for informant vehemently opposed the prayer

Considering the aforesaid submissions of the parties, the materials available on record, particularly the young age of the petitioner, her clean antecedents, and that FIR itself has employment agreement dated 04.10.2024, and the fact that anticipatory bail has already been granted to the co-accused, Prachi Chaurasiya @ Prachi Raj, let the petitioner named above be released on anticipatory bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each of the satisfaction of learned Court of A.C.J.M., V Gaya/concerned court, in connection with Civil Lines P.S. Case No. 93 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
