Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 115(2), 109(2), 352, 351(2), 351(3) and 3(5) of BNS.

The case of the prosecution is that the petitioner has assaulted with iron rod on the head of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that there is allegation of only single blow and there is no repetition of the blow. From perusal of the injury report, it will transpire that the informant has received simple injury. Moreover, he is languishing in judicial custody since 13.12.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that petitioner is having five criminal antecedents.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kutumba P.S. Case No. 187 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Aurangabad.
