The petitioner apprehends arrest in connection with Wazirganj P.S. Case No. 570 of 2022, punishable for the offences registered under Sections 147, 148, 149, 323, 337, 307, 504 and 506 of the Indian Penal Code.

The prosecution case, in short, is that, the petitioner along with other co-accused persons assaulted the informant and his family members by means of iron rod, lathi, bhala and tangi due to which they sustained injuries.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Learned counsel for the petitioner further submits that no specific allegation has been attributed against the petitioner. is case and counter case between the parties. The injuries received by the injured are simple in nature. The petitioner has got no criminal antecedent. Learned counsel for the petitioner further submits that other co-accused has been granted bail by this Court vide order dated 20.12.2024 passed in Cr. Misc. No. 33281 of 2024.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Wazirganj P.S. Case No. 570 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
