The petitioner apprehends arrest in a case instituted under Sections 115(2), 126(2), 109 and 3(5) of the B.N.S.

As per prosecution case, the accused persons including petitioner were ploughing and seeding the field of husband of the informant. When the husband of informant protested, one co-accused Chandan Kumar inflicted rama blow causing head injury to him. Petitioner is alleged to have started threatening them having a pistol in his hand.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is no specific allegation against the petitioner. No incriminating material has been recovered

from possession of the petitioner. Petitioner has completed civil engineering in NIT, Tripura and is preparing for competitive examination. The petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and the trial.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned court concerned in connection with Nasriganj P.S. Case No.279 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
