Heard learned counsel appearing on behalf of the

petitioners and learned APP appearing on behalf of the State.

The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 115(2), 109, 74, 125, 329(4), 303(2) and 61(2) of the B.N.S..

As per prosecution case, on 23.07.2024 at about 10:30 AM, all the F.I.R. named accused persons, including these petitioners, armed with lathi, fatha, iron rod and country made pistol, surrounded son of informant and co-accused Kalam

Ansari, Eklakhur Rahman Ansari, Ajim Ansari, Asfak Ansari and Aslam Ansari assaulted him due to which he received injuries and fell down on the ground. When informant and her family members went to save him, all the named accused persons assaulted them due to which they also sustained multiple injuries. It is further alleged that the accused persons also outraged the modesty of female members of the family and looted ornaments worth Rs. 2,00,000/-.

It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, both parties are neighbors and due to petty dispute, maar-peet took place between the parties in which both sides sustained injuries. There is case and counter-case. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against these petitioners. Petitioners claim clean antecedents.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
