Heard learned counsel for the petitioners and learned

APP for the State.

The petitioners apprehends their arrest in connection with Alauli P.S. Case No. 87 of 2025 instituted for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 351(3) of BNS.

As per the allegation in the FIR, on 20.02.2025 when son of the informant was collecting gitty (stone) beside his house then all the accused persons including present petitioners came there and started abusing and assaulting the informant and

her son by throwing bricks upon them after which informant’s son got injured. It is further alleged that accused persons have also snatched golden chakti and earring from the informant and also took 47,000 cash from the house of the informant.

Learned counsel for the petitioner submits that petitioner are innocent and have falsely been implicated in this case. He submits that there is general and omnibus allegation against the petitioners. He next submits that as per the FIR, it is alleged that accused persons have abused and assaulted the son of the informant after which he got injuries but no injury report has been brought on record by the prosecution side. He further submits that petitioner nos. 1, 3 and 4 are ladies and all the four petitioners have also got clean antecedents as stated in para-3 of the bail petition.

Learned APP for the State opposes the prayer for anticipatory bail of the petitioners.

From perusal of the First Information Report and the impugned order dated 21.05.2025, it appears that there is general and omnibus allegation against the petitioners and no injury report of the injured has been produced by the informant and also the fact that petitioner nos.1, 3 and 4 are ladies and all the four petitioners have got no criminal antecedents as stated in

So, considering all facts and circumstances of the case and submissions made by learned counsel for the petitioners, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Trial Court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 87 of 2025 subject to the conditions as laid down under Section 482(2) of the BNSS.
