This is an application for regular bail on

behalf of the petitioner for the offences alleged under Sections 137(2), 96 and 3(5) of the BNS, registered in connection with Kadwa P.S.Case No. 31 of 2025.

As per allegation, co-accused persons

facilitated conversations between the alleged victim and the petitioner, who is the resident of Uttar Pradesh. Later on, the daughter of the informant became traceless.

The learned counsel for the petitioner has submitted that the petitioner is not the kidnapper. He

solemnized the marriage with the victim. According to the allegation, he purchased the victim for Rs.3,00,000/and the person who faciliated the marriage have been granted bail by coordinate Bench of this Court in Cr.Misc.No. 39199 of 2025 and Cr.Misc.39242 of 2025. The petitioner is under custody since 02.03.2025.

On the other hand, the learned counsel for he informant and learned APP for the State have opposed the prayer for bail by submitting that the victim is a minor child and the petitioner had purchased her for Rs. 3,00,000/-.

circumstances, specially the clean antecedents and period of incarceration of the petitioner i.e. near about nine months, let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Kadwa P.S.Case No. 31 of 2025, subject to the conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
