Heard learned counsel for the petitioner and

learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 69, 89, 351(2), 352 read with section 3(5)of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that she came in contact with petitioner through Instagram about two years back, further petitioner brought her to Delhi where she started working as a Nurse and he and the petitioner also introduced her to his parents and other family members and disclosed that they are married, further she became pregnant, but pregnancy was aborted at Awam Hospital,

Noida and petitioner fled to his village Patedha, next alleges that she came to Patedha where petitioner’s family members called her characterless and ousted her from the house threatening, further petitioner on 10.10.2025, petitioner again contacted her and asked her to meet at Everyday Inn at Hajipur, accordingly she came and petitioner made her pay the bill and even established physical relations and thereafter started leaving the hotel, but she raised an alarm when people came and petitioner was taken to the Police Station where petitioner’s parents and other family members came and said to take Rs. 3,85,000/which she had spent on petitioner and they will never threat her again, thereafter gave an amount of Rs. 1,85,000/- and also refused to marry the petitioner with her. It is next alleged that she does not understand Hindi but only Odia and English.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that informant alleges that she came in contact with the petitioner through Instagram and thereafter they became friends and even established physical relation. It is next submitted that if the FIR is read in its entirety, it would manifest that the thrust of the

allegation is on the money which the informant claims to have spent on the petitioner and the parents of the petitioner instead of returning the amount spent on petitioner, returned a lesser amount. It is further submitted that the relationship in between petitioner and the informant was consensual i.e. the relationship was in between two consenting adults and as far as allegation of abortion is alleged, the same is alleged to give seriousness to the case. It is next submitted that there was absolutely no promise of marriage nor petitioner ever introduced the informant to his parents disclosing that they have performed their marriage. It is also submitted that when consenting relationship sours, a false case is instituted. It is next submitted that if privilege of anticipatory bail is granted, the petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial

court where the case is pending/successor court in connection with Mahila P.S. Case No. 90 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.

Accordingly, the application stands allowed.

However, it is made clear that in the event if the

Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not cooperating in the investigation, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
