As per the prosecution case, on the accused persons

making an attempt to commit theft late in the night, it is stated that the petitioner was caught at the place of occurrence and five pieces of ROB (CC cribs) were recovered from his possession.

Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner’s possession who has been falsely implicated in the case because of his antecedent. He is in custody since 18.1.2026 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the petitioner having remained in custody since 18.1.2026 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Khagaria P.S. Case no.12 of 2026 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
