Heard learned counsel for the petitioners and the

2 This application has been filed on behalf of the petitioners for grant of anticipatory bail, who are apprehending their arrest in connection with Ander PS Case No 225 of 2024 dated 08.09.2024 registered for the offence punishable under Sections 326 (g), 3 (5) of the BNS.

3 The prosecution case is that on 08.09.2024 at about 2 pm, the informant received information on mobile phone that his shop is burning. When he went there, he found that the articles kept in the shop converted into ashes, details of which have been given in the FIR. Further case of the prosecution is

that in the CCTV footage, there is shadow of one person who put the shop on fire. It is further alleged that petitioners threatened the informant on account of old enmity that they will put him to his feet.

4 The learned counsel for the petitioners submits that the petitioners have been implicated in this case due to old dispute with regard to some money transaction between the parties. In the entire FIR, there is nothing concrete against the petitioners except suspicion. It is further submitted that even in the case diary, except phone calls from petitioners to informant, there is nothing material to show that the petitioners are involved in the alleged crime. It is also submitted that petitioner No 1 is a man of clean antecedent and against petitioner No 2, there is one case under the Excise Act.

5 The learned counsel for the State vehemently opposed the prayer for bail.

6 Having considered the rival submissions and the fact that there is nothing in the FIR to fasten the criminal liability against the petitioners, I am inclined to grant anticipatory bail to the petitioners.

7 Let the petitioners above named, in the event of their arrest/surrender within a period of four weeks from today,

be released on bail on each of them furnishing bonds of Rs 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned JM, First Class, Siwan in Ander PS Case No 225 of 2024 subject to all conditions as laid down under Section 482 (2) of the BNSS.
