Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Paharkatta P.S. Case No. 43 of 2026, instituted for the offences under Sections 64(1), 64(2), 65(1) and 351(2) of the BNS and Section 4/6 of the POCSO Act and Sections 66(E) and 67 of the I.T. Act.

The prosecution story, in brief, is that the informant, Laxmi Devi, alleged that the petitioner established contact with the minor daughter aged about 14 years and used to lure and influence her. It is further alleged that the petitioner induced the victim and prepared objectionable videos of the victim girl. The informant has alleged that the petitioner threatened the victim that such videos would be circulated on social media in case she disclosed the

matter to anyone. On the basis of the said allegation, it has been alleged that the petitioner sexually exploited the victim. The informant requested for confiscation of the petitioner’s mobile phone to obtain obscene video of her daughter.

Learned counsel for the petitioner submits that the petitioner is languishing in judicial custody since 23.02.2026 without any rhymes or reason. He further submitted that petitioner is innocent and has falsely been implicated in this case merely on the basis of one criminal antecedent and previous enmity between the parties.

Learned APP for the State opposes the prayer for grant of bail and submitted that there is direct allegation against the petitioner.

Having heard the parties and taking into account the age of the victim and the allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
