2 . The petitioner has preferred this application for grant of regular bail in connection with Kadam Kuan P.S. Case No. 152 of 2025, registered for the offences punishable under Sections 420 of the Indian Penal Code.

As per the allegation, one Raushan Singh (petitioner) came in the month of June 2024 and said that he is doing survey for extending benefit of government schemes in mohalla and after survey, the poor would be paid Rs. 2,000/under Prime Minister Scheme and Rs. 1,000/- under labour scheme and after taking them in confidence, he took Aadhar card and Pan card of nine persons and opened their Bank Accounts after 13.06.2024 in different Banks. It has further been

alleged that he took Pass-books and ATM cards of those accounts on the pretext of updating the record of office and has provided such mobile numbers in the said accounts which were not in the possession of account holders. Several credit and debit transactions in each account were made. Also, new SIM in the name of Shani Raj and Nisha Devi were taken which were also in the custody of petitioner Raushan Singh. In this way, the petitioner Raushan Singh, fraudulently opened the accounts in the name of nine persons and illegally operated such accounts and illegally made transactions in the said accounts so that if any case is filed with respect to those accounts, the holders of the account will be liable.

Learned counsel for the petitioner has submitted that the prayer for regular bail of the petitioner was initially rejected by the court below by order dated 15.12.2025, wherein observation was given to renew his prayer for bail after framing of charges. It has further been submitted that the petitioner renewed prayer for bail before the Court below armed with the aforesaid liberty moved before this Court in Cr. Misc. No. 3880 of 2026, and by order dated 07.04.2026, the application was permitted to be withdrawn. It has further been submitted that the petitioner renewed a fresh application before the Court below

after framing of charges but by order dated 21.05.2026, the prayer for bail of the petitioner was rejected. It has further been submitted that the petitioner has falsely been implicated in this case. It has further been submitted that the only material against the petitioner is that he tried to derive benefit by opening bank accounts. It has further been submitted that there are no transactions in the said accounts of the beneficiaries and no money of the Government Scheme has been received in those accounts nor any amount was defrauded from the bank accounts of the beneficiaries. It has further been submitted that the petitioner has been made accused in two another cases but till date he has not been remanded in those cases. It has lastly been submitted that the petitioner is in custody since 31.08.2025, and now charges have been framed in this case and the case is triable by the Court of learned Magistrate.

5 . Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

7. Considering the facts and circumstances of the case

as well as the period of custody, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like

amount each to the satisfaction of learned J.M., 1^st Class, Patna, in connection with Kadamkuan P.S. Case No. 152 of 2025,
