The petitioners have filed the present application for quashing the FIR bearing Buxar (Town) P.S. Case No. 550 of 2022 dated 09.10.2022 registered under Section 420, 406, 467, 468, 471 and 34 of the Indian Penal Code, pending the Court of learned Chief Judicial Magistrate, Buxar.

As per the allegation, the informant Amit Kumar Rai alleged that on 20.05.2020, the petitioner no.2 Dara Pathak

and the co-accused persons Sanjeev Kumar and Vikash Rai came and told the informant that they have seen a land at Mauja-Jaso, Thana No.330, Chak Khata-76, Chak Khesra-285, Area-20.5 decimal, and told the informant to deposit amount in the account of land owner and he will execute the land. The informant transferred Rs. 35.75 Lakhs in the account of the petitioner nos. 2 and 3, Dara Pathak and Abhimanyu Pathak and the co-accused persons, Manoj Kumar Pathak, Usha Devi, Krishna Pathak, Indu Devi, Vindhyachal Pathak,. But after taking the money, the petitioner Dara Pathak and the co-accused persons Sanjeev Kumar and Vikash Rai got the alleged land executed in their own names instead of the informant’s name. When the informant told them to cancel the sale deed, then the petitioner and co-accused persons abused and threatened him.

Learned counsel for the petitioners and Opposite Party No.2 have jointly submitted that a joint compromise petition has been filed which is on record as flag ‘B’. It has further been submitted that good sense has prevailed between the parties. It has further been submitted that compromise has been effected between the parties without any threat, coercion and promise. It has further been submitted that as far as Sections 420 and 406 are concerned they are compoundable, while

offences under Section 467, 468 and 471 are not made out in the facts of the case. It has further been jointly submitted that the dispute is primarily civil in nature and the parties do not want to litigate any further.

Heard the learned counsel for the parties and perused the records.

¶25

Considering the entire facts and circumstances of the case and the compromise having been effected between the parties, in the interest of justice FIR bearing Buxar (Town) P.S. Case No. 550 of 2022 is hereby quashed.
