The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 191(2), 190, 115(2), 126(2), 109(1), 303(2), 351(2) and 352 of BNS.

The case of the prosecution is that the petitioner along with others has assaulted the son of the informant with rod.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the FIR, it is clear that the occurrence is of 06.03.2026 whereas the FIR was lodged on 09.03.2026. There is delay but the same has not been explained. Learned counsel has submitted that the

informant is the resident of Sheikhpura whereas according to the Fir, the injured was brought to Nawada for treatment, however, the hospital was very much near to the place of occurrence. It has also been submitted that the nature of allegation is general and omnibus. The injury report has been obtained from a private hospital and according to which, there is fracture of Tibia left and proximal displayed fracture of right shaft. Learned counsel has further submitted that there is no specific allegation against this petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 03.04.2026.

Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail and have submitted that the petitioner along with others has badly assaulted the son of the informant.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chewara (Chewada) P.S. Case No. 29 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
