Heard learned counsel for the petitioners and learned

APP for the State.

The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 14.06.2020 at 8.00 P.M., four named accused persons including the petitioners came to his house and started abusing. On objection, Ravin Kumar (petitioner no.3) assaulted the informant by rod causing injury on head and he became

unconscious, thereafter Dablu Yadav (petitioner no.2) assaulted his brother Sagar by lathi causing injury on elbow and accused persons vandalized his house and Chhatri Yadav snatched his chain. Further, the reason for the occurrence is that accused intend to grab his land.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that from perusal of the allegations as alleged in the FIR, it would manifest that though informant is alleged to have assaulted by Dablu causing injury on elbow which is non-vital part of the body and Chhatri Yadav is alleged to have snatched his chain, the said allegation is ornamental, but then fairly submits that Ravin Kumar is alleged to have assaulted the informant by rod causing injury on head.

Learned A.P.P. opposes the anticipatory bail application and submits that there is a specific allegation against Ravin Kumar of assaulting the informant by rod causing injury on head on account of which, he became unconscious, but then fairly submits that as far as petitioner nos.1 and 2 are concerned, the allegation against them is of assaulting on non-vital part of the body and snatching chain, on which the learned counsel appearing on behalf of the petitioners submits that allegation of snatching

chain is ornamental in nature.

After hearing the learned counsel for the parties, the petitioner nos.1 and 2 , above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Lakhisarai (Ramgarh Chowk) P. S. Case No.320 of 2020, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
