Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and counsel appearing on behalf of the informant.

The petitioner is languishing in jail custody since 12.02.2026 for the offence under Sections 137(2), 96 and 3(5) of the BNS in Sahebganj P.S. Case No. 596/2025.

It is alleged that on 12.10.2025, while the minor daughter of the informant went out from her house to defecate, all the accused persons abducted her with intention to marry her forcibly.

Learned counsel appearing on behalf of the petitioner submits that even though the victim in her statement recorded under Section 183 of BNSS, has named the petitioner alongwith Sabita Devi and others but one of the co-accused of

this case Sabita Devi who was also named in 183 BNSS statement has already been granted anticipatory bail by a Bench of this Court by order dated 21.05.2026 passed in Cr. Misc No. 33959/2026 on account of the fact that the victim has married to the main accused namely Dheeraj Nat after recording of her statement u/s 183 of BNSS.

Learned counsel for the informant has not disputed the aforesaid position and has not opposed the bail application of the petitioner.

Taking into consideration the entirety and facts and circumstances of the case that one of the co-accused of this case has been granted anticipatory bail and petitioner bears no criminal history, the prayer for bail on behalf of the petitioner is allowed. He is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Learned A.C.J.M- 2^nd (West), Muzaffarpur in connection with Sahebganj, P.S. Case No. 596/2025, subject to the following conditions:-

(i) The petitioner shall co-operate in the investigation

or trail as the case may be.

(ii) One of the bailors must be close relatives of the petitioner such as mother, father, brother, sister, or wife.

(iii) The petitioner will appear on each and every date fixed by the trial Court during trial and if, he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner after giving opportunity to him.
