Heard the learned counsel for the petitioner as well as

the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection with M.H. Nagar P.S. Case No. 149 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2), 3(5) of the BNS and Section 27 of the Arms Act.

As per allegations in the prosecution case, the informant alleged that on 05.04.2026 at about 5:30 P.M., while he was proceeding from Hasanpura to Jalalpur on his e- rickshaw, all the petitioners, travelling in three Scorpio vehicles bearing registration Nos. BR01HW7004, BR01JX7721 and BR29BA3155, intercepted him near Village Semari. It is alleged that they surrounded the informant, started hurling abuses and opened fire upon him.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. He has further submitted that the allegations against the accused persons, including the petitioner, are general and omnibus in nature. He has also submitted that no injury was found on the person of the informant and that, no incriminating article has been recovered from possession of the petitioner. He has next submitted that the petitioner has been made accused in the present case as because he has criminal antecedents of 12 cases in his credit, as mentioned in paragraph no. 3 of the main bail petition. He has further submitted that the other co-accused persons have already been granted bail by the court below itself. The petitioner has been in judicial custody since 06.04.2026.

On the other hand, learned APP for the State has opposed the prayer for bail, stating inter alia that the petitioner had fired upon the informant, however, he does not dispute the fact that no one sustained injury in the occurrence.

Taking into account the entire facts and circumstances of the case, especially the fact that no injury has been found on the person of the informant, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing

bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned J.M.-Ist Class, Siwan in connection with M.H. Nagar P.S. Case No. 149 of 2026, subject to the following conditions:-

(i) The petitioner shall cooperate in the disposal of

trial.

(ii) One of the bailors must be close relatives of the petitioner such as mother, father, brother, sister or wife.

(iii) The petitioner will appear on each and every date fixed by the trial court and if, he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.

(iv) Before submission of his bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if he is found involved in any case other than the cases as mentioned in para-3 of the bail petition, the court below shall not accept his bail bond.
