Heard learned counsel for the petitioners and learned

APP for the State.

The petitioners are apprehending arrest in connection with Amarpur P.S. Case No. 471 of 2020 lodged on 14.08.2020, for the offence punishable under Sections 341, 323, 307, 354, 504, 506 & 34 of the Indian Penal Code.

As per the prosecution, FIR has been lodged against nine named accused persons including the present petitioners with allegation that they all reached at the shop of the informant and assaulted the informant by iron rod and lathi on his head, due to which, he sustained injury.

Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. Counsel submits that the present FIR has been lodged on 14.08.2020, whereas, on 13.08.2020 also, the dispute has arisen. He submits that both the parties are resident of the same locality and they are well known to each other. He submits that due to intervention of the well wishers, the parties have filed compromise petition that grievance has been settled and they are not ready to contest against each other. In this regard, they have filed application before the C.J.M., Banka. He further submits that the petitioners have clean antecedent and there are case and counter case from both the sides.

Learned APP for the State opposes the prayer for bail of the petitioners but submits that due to intervention of the well wishers, parties are not ready to contest against each other.

As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of C.J.M., Banka, in connection with Amarpur P.S.
