The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘the BNSS, 2023’) for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Piyar P.S. Case No. 190 of 2025, lodged on 24.10.2025, under Sections 126(2)/115(2) /118(1) /109 /351(2) / 352/3(5) of the Bhartiya Nyay Sanhita, 2023.

As per the prosecution, FIR has been lodged against four named accused persons including the present petitioners with allegation that they came with iron rod, spade bricks, and

stone in their hand at the house of the informant and started abusing and assaulted him due to which he sustained injury.

Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that petitioners and informant both live in the same courtyard. Counsel submits that due to land dispute the petitioners have falsely been implicated. Counsel submits that wife of petitioner No.1 and petitioner have registered case against the informant. Counsel submits that petitioner No.1 is elder and petitioner No.2 is younger brother of the informant. Counsel submits that the criminal antecedent of the petitioners is clean. Counsel further submits that petitioners are ready to fulfill all the conditions whatsoever shall be imposed upon them.

Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that both petitioners and informant are brothers.

Considering the present facts and circumstances, let the above named petitioners be released on provisional anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)

each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned A.C.J.M.-X, Muzaffarpur, in connection with Piyar P.S. Case No.190 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS , 2023.

The Trial Court is directed to explore the possibility of an amicable settlement of the dispute between the parties. Learned Counsel for the petitioner has assured the Court that they shall make efforts to settle the matter amicably.

Learned counsel for the informant has also assured the Court that he shall cooperate in arriving at a permanent settlement between the brothers.

¶25

Upon perusal of the Mediator’s report, the Trial Court shall either confirm the anticipatory bail or pass appropriate orders in accordance with law, as the case may be.
