The learned APP at the outset submits that petitioner

had earlier moved this Court seeking anticipatory bail by filing Cr. Misc. No. 60435 0f 2024 and the same came to be allowed by an order dated 12.09.2024 with a direction to the learned trial court to verify the criminal antecedent of the petitioner and if it was found that petitioner had antecedent of even one case in that event the anticipatory bail order shall not be given effect to, it is next submitted that since the petitioner had antecedent of one case and the said antecedent was concealed in Cr. Misc. No. 60435 0f 2024 as such the petitioner did not surrender before

the learned trial court within the time specified fearing that the bail bond will be accepted. It is next submitted that thereafter the petitioner filed Cr. Misc. No. 2673 of 2026 with a prayer for modifying the order dated 12.09.2024 passed in Cr. Misc. No. 60435 0f 2024 but then the said Cr. Misc. No. 2673 of 2026 also came to be rejected by an order dated 17.01.2026.

The learned APP thus submits that a person who does not approach the court with clean hands should not be dealt leniently. It is further submitted that from the facts as recorded hereinabove reflects the character of the petitioner that he is moving at his leisure i.e. despite anticipatory bail granted on 12.09.2024 the petitioner choose not to surrender within a reasonable period of time. It is also submitted that the petitioner is in custody since 22.01.2026. It is next submitted that if the privilege of regular bail is granted, the petitioner may abscond.

Learned counsel appearing on behalf of the petitioner is not in a position to rebut the submissions made by learned APP. It is fairly submitted that the facts as recorded hereinabove cannot be faulted.

After hearing the learned counsel for the parties, the Court is not inclined to release the petitioner on bail in connection with Matihani P.S. Case No. 48 of 2024 pending in the Court of
