Heard Mr. Prabhakar Singh, learned counsel for the petitioner and Mrs. Sharda Kumari, learned APP for the State.

The petitioners are apprehending their arrest in connection with Daraunda P.S. Case No. 431 of 2025 for the offence under sections 103(1), 238, 3(5) of the B.N.S. lodged on 01.09.2025 by the informant, Sonu Kumar Manjhi.

As per the prosecution story, the informant received information about an unidentified body of woman lying in the water. Upon receiving the information, the informant went to the place and also informed the Station Head of the Daraunda Police Station. This led to the F.I.R.

The body was recovered from the water, she was a young woman but no one in the locality could identify her. It was

sent to the Sadar Hospital, Siwan for the postmortem. Prima facie, they came to the conclusion that the lady has been murdered elsewhere and then dumped into the water. This led to the FIR.

Subsequently, the investigation took place and Om Prakash Yadav who was hired by the petitioners on 31.08.2025 informed that in the morning at 05:10 AM, the petitioner no. 1 called him and informed that there is an urgency and they have to move to the hospital. He reached the place with the car.

The petitioner no. 1, the petitioner no. 2 and the son of the petitioner sat with the lady, Sanjana (deceased) and kept her between the mother and the brother. As the car was moving, and there was certain stop, the lady was thrown between the seats and then the driver realised that she is no more. He stopped the car and refused to move ahead.

Petitioner no. 1 thereafter, called another car and tried to pay him through cash, the driver wanted it to be online whereafter, the online transaction was made. He was further threatened of dire consequences by the petitioner no. 1. Later, they sat in the another car and left the place. The deceased was later identified as Sanjana, the daughter of the petitioner no. 1 and 2.

The Dy. S.P., Maharajganj supervised the entire matter and in paragraph no. 68, he has recorded the facts as also the statement of the driver and have found the case of killing of the

daughter of the petitioners to be true and the role has been attributed to the two petitioners besides their son.

Learned counsel for the petitioners submit that only on the basis of the statement of the driver, the entire story has been created and the petitioners who are unfortunate parents of the girl, have found themselves implicated.

Learned APP on the other hand, opposes the prayer submitting that the entire facts clearly point finger towards the two petitioners as the dead body was found on 01.09.2025 and till date, no information whatsoever was given by the petitioners regarding missing of their daughter. Only after the investigation took the Police to the doors of the driver of the vehicle, he spilled the beans and which led the matter come to the surface.

Taking into account the submissions of the parties as also that the unfortunate role that has been attributed to the two petitioners who are parents of the young girl who left this world untimely, no relief can be extended.

The anticipatory bail application stands rejected.
