Patna High Court (Ashok Kumar Pandey, J.), by oral order dated 29-06-2026 in Criminal Miscellaneous No. 22836 of 2026, allowed the bail application of Tufani Kumar in G.R. No. 3570 of 2025 arising out of Khagaria Muffasil P.S. Case No. 181 of 2025, registered under Sections 25(1-b)a, 25(1)(a), 26(a) and 26(b) of the Arms Act. The prosecution case was that a country-made pistol and other articles used in manufacturing illegal arms were recovered from a ditch in an open field at Jaralhiya Bahiyar. case. He also submits that nothing has been recovered from the possession of the petitioner. The witnesses of the seizure list are police personnel and the police has not complied with Section 105 of the BNSS while making the seizure. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 26.12.2025.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with G.R. No. 3570 of 2025 arising out of Khagaria Muffasil P.S. Case No. 181 of 2025.
