Heard learned counsel appearing on behalf of the

petitioner and learned APP for the State.

The petitioner seeks pre-arrest bail in connection

with Mokama P.S. Case No. 106 of 2025 registered for the offence(s) punishable under Sections 126(2), 127(2), 115(2), 117(2), 109(1) and 61(2) of the BNS.

Considering the nature of the allegations made against the petitioner, I find that the informant’s son, Saurabh Kumar, himself accompanied the co-accused, Sumant Kumar, on his assurance that he would recover a sum of Rs.69,000/from Amit Kumar, to whom the informant’s son had earlier given Rs.1,20,000/-. Allegation is that the petitioner along with Sumant Kumar and other co-accused have brutally assaulted the

son of the informant and thereafter left him along side the railway line, finding him dead. I find that complicity of the petitioner in the alleged offence cannot be denied. Accordingly, the present bail application stands dismissed.

However, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail. In that case, the learned District Court is directed to consider the bail application of the petitioner on the same day and pass necessary order on the basis of material which has come in course of investigation without delay.
