Prosecution case, in brief, as per written report of informant Mohan Kumar is that, on 8/9/2025 at 06:00 AM, he found that his brother Vipin Kumar had been murdered in his new house. He suspects that these petitioners along with other accused persons have killed his brother with a sharp knife, due to enmity.

Learned counsel for the petitioners submits that informant is not an eye-witness to the occurrence and has not disclosed the source of information as to how he came to know that petitioners and other co-accused have killed his brother. During investigation, none of the witnesses have claimed to have seen these petitioners committing the alleged offence. Similarly situated co-accused has already been allowed bail by this Court vide order passed in Cr.Misc.No. 8363/2026. Petitioners claim clean antecedent.

Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period
