Heard learned counsel appearing on behalf of the petitioner, learned APP for the State and learned counsel for the complainant.

The petitioner seeks pre-arrest bail in connection with Complaint Case No. 38C of 2021 registered for the offence punishable under Section 420 of the Indian Penal Code.

As per the allegations made in the complaint, the petitioner, despite repeated requests, allegedly failed to return back a sum of Rs. 1,05,000/- to the complainant.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner is ready and willing to

return back the entire amount to the complainant within a period of four weeks to buy peace of mind.

Learned counsel appearing on behalf of the complainant submitted that a specific time frame may be fixed by this Court, considering that the complaint was instituted on 08.02.2021 and the total amount of Rs. 1,05,000/- had been transferred to the account of the petitioner on 10.07.2017 and 21.07.2017.

Considering the nature of allegation made in the complaint, the matter is purely civil in nature and the fact that the petitioner has admitted that he is willing to return back the entire amount within a period of four weeks, I find that the petitioner has made out a case to be released on pre-arrest bail provisionally.

The petitioner, above named, is directed to be released on pre-arrest bail provisionally, on such terms and conditions as the learned District Court deems it fit and proper.

In case, the petitioner returns the entire amount to the complainant within a period of four weeks, the provisional bail granted to the petitioner shall be made absolute.
