Additional Public Prosecutor for the State.

The petitioner seeks bail in Patarghat P.S. Case No. 104 of 2025 registered for the offences punishable under Sections 103(1) and 61(2) of BNS 2023.

The allegation is that the mother of the deceased has lodged the case claiming that her daughter-in-law along with the petitioner and others has killed her son.

Learned counsel for the petitioner submits that the informant is not an eye-witness to the occurrence. There is no direct evidence against the petitioner. Moreover, the postmortem report shows the cause of death to be asphyxia due to hanging.

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.
