The petitioner seeks bail in Mohammadpur P.S. Case No. 178 of 2025 registered for the offences punishable under Sections 103(1), 238 and 3(5) of Bhartiya Nyaya Sanhita, 2023.

The allegation is that the husband of the informant has killed her newly born child.

Learned counsel for the petitioner submits that there is no eye-witness to the occurrence and the child was of sixteen days. He further submits that the child was suffering from jaundice. It is also submitted that the petitioner is in custody since 23.08.2025 and has no criminal antecedent.

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.

Considering that the petitioner is in custody since 23.08.2025 and has no criminal antecedent as well as the fact that no motive has been assigned for this gruesome allegation, this Court is inclined to grant bail to the petitioner after framing of charge.
