This appeal is preferred against the order dated 17.12.2025 passed by the learned Additional Sessions Judge-Icum-Special Judge, SC/ST (POA) Act, Supaul in RB (SC/ST) No. 72 of 2025 / SC/ST Case No. 122 of 2025 arising out of Pratapganj P.S. Case No. 197 of 2025 registered for the offence under Sections 70(1), 3(5) of the BNS and under Sections 3(2)

As per the prosecution case, the appellant is accused of committing gang rape with the victim.

The appellant is in custody since 21.09.2025.

Learned counsel for the appellant has submitted that the appellant is innocent and has falsely been implicated in this case. He next submits that this is a case of consensual sex between the alleged victim and the accused persons.

From the perusal of the FIR, it appears to be a case of gang rape and considering the same, this Court is not inclined to interfere with the impugned order.
