The present Civil Miscellaneous application has been

filed by the petitioner for directing the learned Sub-Judge-II, Patna to dispose of the Eviction Suit No. 96 of 2022 expeditiously.

Learned counsel for the petitioner/plaintiff submits that he has filed Eviction Suit No. 96 of 2022 under Bihar Buildings (Lease, Rent & Eviction) Control Act on the ground of personal necessity and default of rent. Learned counsel further submits that earlier, this case was being heard ex-parte due to non appearance of defendant/respondent. Subsequently he appeared and ex-parte order of hearing was recalled and thereafter the case is being delayed due to miscellaneous

reasons. Lastly he submits that, proper direction may kindly be given to Sub-Judge 2^nd , Patna to dispose of the matter at the earliest.

Keeping in view the aforesaid facts, learned Trial Court is directed to dispose the matter at the earliest preferably within a period of six months and both the parties are directed to diligently co-operate in the trial.

Accordingly, the instant Civil Miscellaneous application stands disposed of.
