Heard learned counsel for the petitioner, learned SC-13 for the State and the learned counsel appearing on behalf of Babasaheb Bhimrao Ambedkar Bihar University, Muzaffarpur (hereinafter referred as ‘the University’) Mr. Sunil Kumar Karn.

The case has been listed under the heading ‘office notes’ for the reason that by order dated 21.07.2025, notices were issued on respondent no.6. The office has pointed out that address mentioned on the requisites filed for respondent no.6 is

vague and does not tally with the address mentioned in the writ petition, as such the learned counsel for the petitioner has been requested to verify and correct the mentioned address.

The learned counsel appearing on behalf of the petitioner submits that though requisites were filed in time but then inadvertently mistake in recording the address of respondent n.6 was made. It is also submitted that correction in the address of the respondent no.6 in the writ application is also required.

At this stage, the learned counsel appearing on behalf of the University submits that petitioner is aggrieved by an order dated 11.12.2024, contained in Memo No. B/3314 issued by the Registrar of the University, whereby the petitioner who was the senior-most teacher of Dr. S. K. S Women’s College, Motihari was posted as Professor In-charge, was relieved and one Professor, Pankaj Kumar, Professor, Department of Physics, L.S. College, Muzaffarpur (respondent no.6) was authorized to discharge the duties and function of the office of the Principal, Dr. S.K.S Women’s College, Motihari with immediate effect. It is further submitted that petitioner was aggrieved by the fact that the order dated 11.12.2024, issued by the Registrar of the University, did not even remotely suggested

that respondent no.6 has been transferred/deputed/posted at Dr. S.K.S Women’s College, Motihari for discharging the duties of Principal, rather the order authorizes the said Professor Pankaj Kumar to discharge the function of Principal of Dr. S.K.S Women’s College, Motihari, apart from discharging his duties in M.S. College, Muzaffarpur.

The learned counsel for the University next submits that the grievance of the petitioner now stands redressed as Dr. Nalin Bilochan has been appointed as the Principal of Dr. S.K.S Women’s College, East Champaran, Motihari and he has jointed the college on 25.07.2025. It is submitted that since the order dated 11.12.2024, contained in Memo No. B/3314 issued by the Registrar of the University has been stayed by this Court by an order dated 21.07.2025, as such, the present petitioner in view of the aforesaid stay order, started discharging the function of in-charge Principal, Dr. S.K.S Women’s College, Motihari. It is next submitted that since regular Principal has been appointed in the college, as such the grievance of the petitioner stands redressed.

The learned counsel appearing on behalf of the petitioner at this stage seeks permission to withdraw the writ application with liberty to assail the order by which Dr. Nalin
